1. Acceptance of Terms

By accessing or using Glintz ("the App", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree to these Terms, please don't use Glintz.

2. Eligibility

Age Requirement

• You must be at least 18 years old to use Glintz
• By using Glintz, you represent and warrant that you are 18 or older
• We reserve the right to verify your age and suspend or terminate accounts that violate this requirement

Account Responsibility

• You are responsible for maintaining the confidentiality of your account
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

3. Description of Service

What Glintz Does

Glintz is a hotel discovery platform that:

• Displays Hotels: Shows curated luxury hotels from around the world
• Swipe Interface: Provides an intuitive way to browse hotels
• Save Preferences: Allows you to like, super-like, and save hotels
• View Details: Shows hotel photos, descriptions, and locations
• Booking Links: Provides links to hotel booking platforms

What Glintz Is NOT

• Not a Booking Agent: We don't handle bookings or reservations
• Not a Hotel: We don't own or operate any hotels
• Not a Travel Agency: We provide information only, not travel services

4. Third-Party Content & Services

Hotel Photos - Google Places API

Hotel photos displayed in Glintz are sourced from the Google Places API and are the property of Google and their contributors.

Hotel Information

• Accuracy: We strive for accuracy but cannot guarantee that all hotel information is current or correct
• Third-Party Data: Hotel data is sourced from various providers and may not be complete
• No Warranty: We provide information "as is" without warranties of any kind

External Links

Glintz may contain links to third-party websites (hotels, booking platforms, Google Maps). We are not responsible for:

• The content, accuracy, or opinions expressed on external sites
• The privacy practices of external sites
• Any products, services, or transactions on external sites

5. User Conduct

Acceptable Use

You agree to use Glintz only for lawful purposes. You will NOT:

• Violate Laws: Use the App in any way that violates laws or regulations
• Impersonate: Pretend to be someone else or misrepresent your affiliation
• Harm Others: Harass, threaten, or harm other users
• Scrape Data: Use automated tools to extract data from the App
• Reverse Engineer: Attempt to decompile or reverse engineer the App
• Interfere: Disrupt or interfere with the App's operation or servers
• Spam: Send unsolicited messages or engage in spamming
• Misuse: Use the App for commercial purposes without our permission

6. Intellectual Property

Glintz Ownership

All content, features, and functionality of Glintz are owned by us and are protected by copyright, trademark, and other intellectual property laws. This includes:

• The Glintz name, logo, and branding
• The App's design, interface, and user experience
• Our curated hotel selections and descriptions
• Original content created by Glintz

Third-Party Content

Content sourced from third parties (photos, hotel data) remains the property of their respective owners:

• Google Photos: © Google and Google Maps contributors
• Hotel Information: © respective hotel owners and data providers

License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use Glintz for personal, non-commercial use only.

7. User-Generated Content

Your Data

Your preferences, likes, and interactions with the App remain your property. However, by using Glintz, you grant us a license to:

• Use your preferences to personalize your experience
• Analyze aggregate usage data to improve the App
• Store and process your data as described in our Privacy Policy

8. Disclaimers & Limitations of Liability

Service "As Is"

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The results or information obtained through the App will be accurate or reliable
• Any defects or errors will be corrected
• The App will meet your specific requirements or expectations

Limitation of Liability

To the fullest extent permitted by law:

• No Liability: We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Maximum Liability: Our total liability to you shall not exceed $100 or the amount you paid to use Glintz (currently $0), whichever is greater
• Third Parties: We are not liable for actions or omissions of third parties (hotels, booking platforms, etc.)

Hotel Bookings

Glintz does not handle hotel bookings, reservations, or payments. When you book through third-party links:

• Your contract is with the hotel or booking platform, not Glintz
• We are not responsible for booking errors, cancellations, or disputes
• We are not liable for any issues with your stay or accommodation
• Review the booking platform's terms before making reservations

9. Indemnification

You agree to indemnify, defend, and hold harmless Glintz, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

10. Account Termination

Termination by You

You may delete your account at any time through the App settings or by contacting us at support@glintz.travel.

Termination by Us

We reserve the right to suspend or terminate your account at any time, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse or misuse of the App
• Any reason at our sole discretion

Effects of Termination

Upon termination:

• Your right to use Glintz will immediately cease
• Your account data will be deleted (subject to legal retention requirements)
• Sections of these Terms that should survive termination will remain in effect

11. Changes to Terms

We may modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top
• Notify you via in-app notification or email
• Give you the opportunity to review the changes

Continued use of Glintz after changes means you accept the updated Terms. If you don't agree to the new Terms, you must stop using Glintz and delete your account.

12. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

13. Governing Law

Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or your use of Glintz shall be resolved through:

1. Informal Resolution: Contact us at legal@glintz.travel to attempt resolution
2. Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration
3. Class Action Waiver: You agree to resolve disputes individually, not as part of a class action

14. International Use

Glintz is operated from the United States. If you access Glintz from outside the U.S., you do so at your own risk and are responsible for compliance with local laws.

Export Control

You agree not to export, re-export, or transfer the App in violation of U.S. export control laws.

15. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Glintz.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.
